Welcome to Be a Kitchen Hero! This Web site located at www.beakitchenhero.com (this "Site") and is owned and operated by Savour Life Foods, Inc. ("Company"). This Site and any purchases made through this Site are governed by the terms of service, use and purchase described below ("Terms"). By using this Site, purchasing items through this Site, and/or enrolling in our Legion of Kitchen Heroes Club (which includes a monthly, automatic purchase feature as described below), you agree to be bound by these terms, so please review this entire page carefully. These Terms are designed to clearly provide you with the general terms and conditions regarding purchasing products from the www.beakitchenhero.com website, Savour Life Foods, Inc and the use of this Site.
The Company reserves the right in its discretion to revise the Terms from time to time, so please check back here periodically for updates. By continuing to use or purchase products from this Site and/or by remaining a member of the Legion of Kitchen Heroes, you accept and agree to the Company's right to revise the Terms from time to time and to be bound by such changes, so long as they are promptly posted on the Site or emailed to the email account we have on record for you. If you do not wish to be bound to these Terms (or any revisions to these Terms), please do not use this Site or the Company's services and immediately cancel your membership by emailing hello@beakitchenhero.com.
BE A KITCHEN HERO MEMBERSHIP
Savour Life Foods provides a monthly membership program that mails a new spice and cooking recipes and information on a monthly basis. Members create their own log-in and can manage their account and will have access to the members-only section of the website. Members can opt to pay monthly or pay their subscription in full upfront.
BILLING, ORDER AND CREDIT CARD INFORMATION
All order must be accompanied by a valid payment for the total sum of the value of the Product and shall be made by a pre-arranged method of payment acceptable to Savour Life Foods.
Savour Life Foods reserves its rights to cancel the order at its sole discretion by reimbursing the sums paid by the Client. Savour Life Foods shall not otherwise be liable to the Client for cancellation of such orders.
Savour Life Foods works to protect your personal information during transactions using a secure system. No personal information collected by Savour Life Foods is shared with any third party. Personal information is only used to contact you as part of the membership program, ship your order, to contact you in case of need, or to let you know about all the opportunities Savour Life Foods has to offer.
When you place your first order, we will save your credit card information for use on all future billings. Any automatic billing and/or charges, as per the membership rules described upon sign-up, will be automatically applied to your saved credit card unless you notify us in advance by emailing us at hello@beakitchenhero.com. We accept Visa and Mastercard as forms of payment. If your payment method reaches its expiration date and you do not edit your credit card information or cancel your account, you authorize us to continue billing that credit card on file including extending the expiration date until we are notified by you or the credit card company that the account is no longer valid. We encourage you to constantly update your payment method information or cancel your account should you wish to discontinue your membership with us
Canadian buyers will be charged in Canadian dollars.
You may cancel your membership at any time. If you wish to cancel your Account, you must notify Savour Life Foods at least five days before your next billing date by emailing us at hello@beakitchenhero.com. There is no cancellation fee. Please be advised that an account may only be canceled by the member.
SHIPPING
Members who purchase 2-month, 6-month or 12-month membership packages will receive free shipping*. *Shipping to certain areas may include a surcharge of $3.50. Free shipping is based on standard Canada Post Shipping rates and available to members only. If the member prefers expedited shipping, then the full expedited rate will be billed minus the standard shipping rate.
Subscriptions will be mailed via Canada Post Monday to Friday on the business day closest to 15th of every month. Arrival will depend on where you are located. When your order ships, you will be provided with a tracking number via email. You can also find your order details and tracking information on the Order History tab within the My Account section.
*Savour Life Foods will ship to any address in Canada unless it is commercially unfeasible. Shipping to remote areas may incur a surcharge. Savour Life Foods may be unable to ship to certain remote regions. Savour Life Foods reserves the right to refuse or cancel orders where Savour Life Foods has no commercially reasonable shipping option, and Savour Life Foods shall not be liable to the Client for cancellation of such orders. In such a case, Savour Life Foods will reimburse the sums already paid by the Client. If an ordered item is damaged during shipping, is incorrect, or missing, immediately contact Savour Life Foods. RETURNS & EXCHANGES
All sales on comestible items ‘food’ are final and no eligible for returns.

Unless otherwise indicated, this Site and all content contained therein, including but not limited to text, photographs, images, icons, graphics, trademarks, trade names, logos and software ("Content"), is owned by Savour Life Foods and protected by applicable law. You agree not to copy, publish, use, display, transmit, modify, transfer, sell, reformat, distribute, create derivative works from, or in any way exploit the Content without the Company's prior written approval. In addition, any mechanized or systematic processes for harvesting information from this Site for any purpose is prohibited. Nothing contained in or on this Site should be construed as granting any license or right, by implication or otherwise, to use any of the Content at any time.

ACCOUNT CONFIDENTIALITY AND ACCESS
You are solely responsible for maintaining the confidentiality of your Account, all activities occurring under your Account and all access to and use of the Site by anyone using your Account, whether or not such activities and access are actually authorized by you, including but not limited to all communications, transactions and obligations. The Company shall not be liable or responsible for any loss or damage arising from any unauthorized use, access or any other breach of security of your Account, including but not limited to your member sign-in password and email address. You acknowledge and accept that your use of the Site is in compliance with these Terms. You further acknowledge and accept that the Company shall have no obligation to investigate the authorization or source of any Account activity, including purchase activity following a proper log-in to the Site, which is defined as a matching and current member sign-in and user password. You shall notify the Company immediately of any unauthorized access to your Account or any other unauthorized use of the Site.
You agree that the Company may, without prior notice, immediately terminate, limit your access to or suspend your Account based on any of the following: (a) breach or violation of these Terms; (b) upon request by law enforcement; (c) unforeseeable technical or security issues or problems; (d) extended periods of inactivity; or (e) fraudulent, deceptive or illegal activity, or any other activity which the Company believes is harmful to this Site or its business interests. You agree that any termination, limitation of access and/or suspension shall be made in the Company's sole discretion and that the Company shall not be liable to you or any third party for the termination, limitation of access and/or suspension of your Account.
INDEMNIFICATION
You agree to indemnify, defend, and hold Savour Life Foods harmless and its officers, directors, employees, agents, investors, and suppliers (collectively the “Service Providers”) against all losses, expenses, damages, and costs, including reasonable legal fees resulting from any violation of these general terms and conditions or any activity related to your account (negligent or wrongful actions included) by you or any other person accessing the website using your Internet account.
ACT OF GOD
For all purposes hereof, force majeure includes any act of God, war, mobilization, governmental regulation, strike, lockout, drought, flood, total or partial fire, obstruction of navigation, loss, damage or detention in transit, defective materials or delays by shippers, or other contingences or causes beyond Seller's control which might prevent the manufacture, shipment or delivery of Goods covered hereby. Performance of Seller's obligations may be suspended pending force majeure, without Seller being responsible to Client for any damages or losses resulting from such suspension.
